NEW YORK (AP) - Yoko Ono has lost her Manhattan legal battle to block the use of John Lennon's song "Imagine" in a film challenging the theory of evolution.
Lennon's widow had sued the makers of "Expelled: No Intelligence Allowed," saying they used parts of the song without her permission.
In a decision Monday, federal Judge Sidney Stein says the filmmakers are protected under the "fair use" doctrine. That permits small parts of a copyrighted work to be used without an author's permission under certain circumstances.
The movie opened on U.S. screens in April; it's set for release in Canada on Friday and on DVD in October.
It presents a sympathetic view of intelligent design, the theory that the universe is too complex to be explained by evolution alone.
Ono's attorney did not immediately return a call for comment.

I did see this movie, and I thought it was extremely well done. It was not a "I.D." propaganda picture by any means. It did not try convince you that I.D. is true, or really evan what I.D. is. If you go into this movie not knowing what I.D. is, this movie will not teach you what it is. What it did do was show people how the majority of people in the world of academia are vehemently opposed to the very thought or idea of I.D. and how they fight like crazy to keep it from even being brought up in an educational setting. It is very eye opening and everyone who is ignorant of the bias is the education system should see this movie.
I haven't seen it yet, but I want to. I have watched the clips on it and it looks very good.

My husband, daughter and I saw it and we all thought it was very well done and interesting. Frankly, I didn't expect to enjoy it very much--I went more as a support for a good project. But I truly enjoyed the movie. There was humor mixed in with thought-provoking discussion. I definitely recommend it!
